Arbitrator

An arbitrator can be defined as a person who has been chosen and authorize to preside over an arbitration proceeding. In other words, he chairs the alternative dispute resolution. Arbitration is a very specialized field and beyond the purview of common men’s awareness. Interestingly, arbitrators are supposed to play the roles of both judge and jury. Arbitration refers to a method of resolving disputes outside the court environment. It is a very important part of the legal field. Arbitrators are legal professionals who address procedural issues. They give fair chance to all the parties involved. They hear to each party’s side of the case, analyze and weigh the facts and after applying the correct law sections, they declare the final verdict. Usually, the judgment of the arbitrators is binding on the parties concerned.

Arbitrators can work in a panel or as a part of an arbitration board or independently. There can be multiple arbitrators in a panel. Many of you might wonder about presence of odd number of people in an arbitration panel. Well, that is purposely done so that there are no deadlocks in the case of final verdict. So if there are 5 members in the panel, the decision will always be rendered 3-2 or 4-1 etc in favor of or against the parties. A chief arbitrator is chosen to lead the panel. Though, he performs the same duties as of other members of the panel but he has the right to set the agenda.

Arbitrators save the parties from the hassles of court proceedings. This way they also help people in resolving conflicts with mutual agreement without incurring the huge costs associated with a court case. Concerned parties must abide by the decision declared by the arbitrator. Arbitrators look at all the minute details including, claim applications, employer records, birth or death certificates and medical records. They can also perform other roles like issuing subpoenas, and administering oaths etc.

To become an arbitrator, one usually needs at least a bachelor degree. However, top arbitrators have master degree in public policy, law and related field. According to law in certain countries and states, arbitrators are required to have a law degree and experience of practicing as a lawyer. Those pursuing this career field prefer to get some valuable practical experience with the help of internships. Others receive specialized training to become certified. Arbitrators need to complete their education and training before they can be hired by the employers.

As a career choice, it is field for those who have strong interest in arbitration. The job demands concrete legal knowledge. Arbitrators also need to be patient, calm and should possess problem solving skills. Determination and critical thinking can go a long way in the career of an arbitrator. In addition, they also need to have excellent listening and communication skills. They should be able to keep information confidential. There are bright job opportunities for arbitrators. Those with right credentials and experience will have no difficulty in finding rewarding jobs on this field.
