The Indian law has several stipulations to protect women against domestic violence. But the idea of leaving a situation and doing something about the future is totally a women’s initiative. A social culture surely rules our mind but at the same time it is imperative to make a bold step about living happily and not dangerously. The Law has made provisions to include as many possibilities of physical abuse and mental trauma and penalize the abuser. The aggrieved must make use of the same and co-operate during times of questioning.
Most times women are weighing the outcome of the situation. Surely it is a bold step but the final decision is in the woman’s hand. In case children are involved a remedy is necessary soonest. A person may be intimidating by nature but succumbing to acts of violence or fear will encourage him further. Hence approaching the court or filing a case is the basic step that provides protection. The decision to forego a marriage can be sequential but fearing about the future is not the right initiative while protecting your life.
Many shelter homes and NGO’s work towards women welfare. Equipping ourselves with education, acquiring a skill, working for a decent living enables us to be upright and realize our self worth. Hence it is essential to understand the legal angle, comprehend the same and apply where there is injustice. Harassment for dowry is unpardonable by law. The asking of dowry itself is an offence and stipulations in legal terms are mentioned in the act.
The law protects situations where the woman is unable to conceive or beget a male offspring which is a pre dominant case of violence at home. The law is constantly being appended and improved to benefit women in all sectors. There is stringent punishment to abetting abuse or helping in conduct of abuse. The harm per se need not be physical. There can be a case of verbal abuse; mocking or insults hailed on the victim which if reported can be used against the abuser.
The court shall extend help to such a victim in order to apply, prepare, collate information and help her with the legal proceedings once the case is filed. The custody of her children is granted to her even before the hearing so that they are safe. Though the law is complete, justice needs time. But much is done for the safety and financial security of the victim.
